General Terms and Conditions for Artwork Submission – ArtFen

1. Purpose
   These general terms and conditions govern the submission of artworks by artists on the ArtFen platform (https://art3.medicomway.com). By submitting an artwork, the artist unreservedly accepts the following conditions.

2. Fees and Payment

• Registration on ArtFen is free of charge.

• In the event of a sale, ArtFen charges a commission on the final sale price. The commission rate is specified at the time the charter and collaboration agreement are accepted.

• Artist payments are made within 15 working days following confirmation of receipt of the artwork by the buyer.

• Shipping costs are the responsibility of the buyer, unless otherwise stated.

3. Artist Commitment

• The artist guarantees that they are the author of the submitted artwork and hold all related usage rights.

• Any fraudulent submission or artwork that does not comply with the platform’s artistic guidelines may be removed without prior notice.

• The artist accepts the selection and validation criteria set by the ArtFen committee.

4. Termination and Cancellation

• The artist may withdraw their artwork from the platform at any time, provided it is not currently involved in a transaction.

• In case of breach of obligations (non-delivery, poor quality, illegal content, etc.), ArtFen reserves the right to unilaterally terminate the agreement.

5. Liability and Indemnification

• The artist remains fully responsible for the content published and the quality of the artworks shipped.

• In the event of a dispute or third-party claim (copyright, counterfeiting, delivery, etc.), the artist agrees to indemnify ArtFen for any damages, expenses, or penalties.

6. Applicable Law and Jurisdiction
   These terms are governed by French law. In the event of a dispute, the parties will attempt to reach an amicable resolution. Failing that, the competent court of Paris shall have exclusive jurisdiction.

General Terms and Conditions of Purchase – ArtFen Platform

1. Purpose
   These terms apply to any purchase made on the ArtFen platform, including original artworks, reproductions, digital works, or downloadable files.

2. Purchase Process

• The buyer selects an artwork and makes a secure payment using the available methods on the website.

• The buyer receives an order confirmation email and delivery tracking information.

3. Prices and Fees

• Prices are displayed in euros, including taxes.

• Shipping fees may be added to the artwork price.

• Any customs duties or local taxes are the responsibility of the buyer.

4. Delivery

• Artworks are shipped directly by the artist or via ArtFen’s logistics services within 7 to 15 working days.

• In case of non-receipt, a claim can be submitted through ArtFen’s customer service within 15 days of the order.

5. Withdrawal and Return

• In accordance with applicable legislation, the buyer has a 14-day right of withdrawal, except for:

  • digital files already downloaded,

  • personalized or custom-made artworks.

• Return shipping costs are borne by the buyer, except in case of error by the platform.

6. Authenticity and Ownership

• Each artwork comes with a certificate of authenticity provided by the artist.

• The purchase of an artwork does not entail a transfer of copyright unless explicitly stated.

7. Liability
   ArtFen acts as an intermediary and cannot be held liable for any losses or damages caused by errors attributable to the artist or the carrier. In the event of a dispute, customer service will attempt to act as a mediator.

8. Applicable Law and Jurisdiction
   These terms are governed by French law. In the event of a dispute, only the courts of Paris shall have jurisdiction.
